Terms and Conditions

1. Parties

These Terms and Conditions (the “Terms”) are entered into by and between Plutos AG, a company with its principal place of business at plutosag.com ,,Plutos AG”, and you, the individual or entity using the Company’s services.

4. User’s Rights and Obligations

The User has the following rights and obligations:

  • Right to Terminate: The User may terminate these Terms at any time by notifying the Company in writing.
  • Right to File a Complaint: The User may file a complaint with the Company about the Services by emailing bartek@plutosag.com.
  • Obligation to Comply with Terms: The User must comply with all of the terms and conditions of these Terms.

5. Company’s Rights and Obligations

The Company has the following rights and obligations:

  • Obligation to Provide Services: The Company will use its best efforts to provide the Services to the User in a timely and professional manner.
  • Limitation of Liability: The Company’s total liability for any claims arising out of or in connection with these Terms shall be limited to the amount of fees paid by the User for the Services in the month immediately preceding the claim.

These Terms are written in English.

7. Entire Agreement

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland.

9. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.

10. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by both parties.

11. Counterparts

These Terms may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

12. Force Majeure

Neither party shall be liable for any failure to perform its obligations hereunder where such failure is caused by an event beyond such party’s reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, government regulations, or fire.

13. Survival

All provisions of these Terms which by their nature survive termination shall continue in full force and effect notwithstanding such termination.

14. Attorneys’ Fees

In any action to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs from the non-prevailing party.

15. Assignment

Neither party may assign its rights or obligations hereunder without the prior written consent of the other party.

16. No Third Party Beneficiaries

These Terms are for the benefit of the parties hereto and their respective successors and permitted assigns and shall not be construed to create any rights or obligations in favor of any third party.

17. Headings

The headings in these Terms are for convenience only and shall not affect the meaning or interpretation of any provision hereof.

18. Amendments

These Terms may be amended only by a writing signed by both parties.

19. Entire Agreement

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

20. Privacy Policy

Your use of the Services is subject to our Privacy Policy, which is available at Privacy Policy. The Privacy Policy explains how we collect, use, and disclose your personal information. You agree to the terms of the Privacy Policy by using the Services. If you do not agree to the terms of the Privacy Policy, you may not use the Services.
